1. Introduction
At Realplay we are committed to your privacy, and we comply with all applicable privacy laws and regulations, including the new General Data Protection Regulation (EU 2016/679). This Privacy Notice (“Privacy Notice”) of Realplay sets forth our policies with respect to information including personally identifiable information (“Personal Information”) and any other information generated while using the services rendered by Realplay (“Services”). This Privacy Notice is incorporated into and is subject to Realplay’s Terms of Use (“Terms”). All capitalized terms used herein and not otherwise defined in this Privacy Notice shall have the meanings ascribed to them in the Terms.

3. Collection of Personal Information by Realplay
While signing up we collect personal information from our Users such as (but not limited to): name, age, email address, role, phone number, class year, school name, team name, and jersey number. For certain enhanced premium services, we may also collect credit card and billing information. Additionally, when users use our services (“Users”) and visit our Website, we automatically collect some non-personally identifiable “computer” information, such as the type of computer operating system, the User’s “IP Address,” the web browser being used, information collected through the use of cookies and information regarding the internet service provider (“Computer Information”).
4. Collection and Sharing of Personal information by Third Parties
The data collection taking place on fields is managed and controlled by the field operator. Realplay is only the processor of the data that the field operator or club passes on to Realplay. Each club and/or field operator shall be responsible to inform its players, members (or any other persons) and if necessary, to obtain their consent to be recorded and to stream the live video on the internet. Realplay shall assume no responsibility whatsoever for any players, members (or any other persons) who were recorded (including video and audio) by Realplay cameras (or by any other device) without their consent and/or without being informed by the event organizer. While playing on a field filmed by Realplay, the Users acknowledge and consent that all the player’s performance (including video from the field, audio, all statistics, etc.) (collectively: “Player’s Performance”) will be automatically recorded and uploaded to the relevant Users’ account at our Website.
The Users will have the option to share their Player’s Performance with their coaches, friends, family and others through the internet. By sharing Player’s Performance through the internet, the Users shall be responsible to obtain the consent of all other relevant players in the video and Realplay shall not be responsible for such sharing.
Our Website may contain links to other sites, including those of sponsors, advertisers and survey companies. Users should consult the other sites’ privacy notices as our Privacy Notice does not cover those sites.
5. Cookies and Web Beacons
Our Website may contain a software technology called “cookies”, which are small text files placed in Users’ computer browsers to store their preferences. Cookies, by themselves, do not provide your e-mail address or other personally identifiable information unless you choose to provide this information by, for example, registering on our Website.
We may also use small pieces of code called “web beacons” or “clear gifs” to collect anonymous and aggregated advertising metrics, such as counting pageviews, promotion views, or advertising responses. These “web beacons” may be used to deliver cookies that conform to our cookie policy.
You may adjust your browser to reject cookies from any website. Certain are as of our Website can only be accessed in conjunction with cookies or similar devices and you should be aware that disabling cookies or similar devices might prevent you from accessing some of our content.
6. Children’s Privacy
Under Children’s Online Privacy Protection Act (COPPA) and under the General Data Protection Regulation (EU 2016/679), we do not collect personal information from Users who identify themselves as under the age of 13 except where we receive verifiable parental consent.
In the case of minors under the age of 13 we will collect the email addresses of both the User and the parents (or legal guardians). We will use the parents’ email address to send the parents messages such as: one-time activation of the child’s account, notify the parent about our privacy practices and send the parents communications regarding the child’s account at Realplay or about features of our Website and/or mobile application.
Any User under the age of 18 must review the Terms and the Privacy Notice with his/her parent(s) or legal guardian(s) to ensure that both the User and the parent(s) or legal guardian(s) understand and accept both the Terms and the Privacy Notice.
We will not condition participation in an online activity on the disclosure of more information than is reasonably necessary to participate in the activity.
We strongly recommend that Users under the age of 13 would ask their parents for permission before sending any information about themselves to anyone. We also encourage parents to teach their children about safe internet use practices.
7. Use of Personal Information
We will not share any Personal Information and/or Player’s Performance without the relevant User’s specific consent. Realplay may present top personal records on Realplay’s leader boards at clubs and on-line, unless the User chooses in his/her profile that Realplay shall not disclose such information.
Realplay may enable live streaming from the Smart Court and presenting Player’s Performance in real-time, only after the club has obtained the consent of the relevant players for such activities. Realplay in any event shall not be responsible for such activities.
For the purpose of creating subscription plans at the clubs and distinguishing between club members, Realplay may provide to the club only limited personal information such as date of birth of the Users.
Realplay may use aggregated information for anonymous statistics and analysis purposes. We also may use Users and Computer Information to track usage, improve the design of our Website, offer products and services, personalize our Users’ experience and save your password in password-protected areas.
Realplay does not carry out automated decision making or profiling that might affect you using your personal data.
You acknowledge that we may access, preserve, and/or disclose your Personal Information, Computer Information, or other information and/or content to a law enforcement agency or another third party if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce our Terms of Use; (c) respond to claims that any content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights ,property, or personal safety of the owners of the Website, the Users and the public.
Your data is stored on a cloud service called Microsoft Azure (US Data Centre). Our contractual agreements and use of their services ensure that we are able to ensure the safety of your data to the best possible extent and that we are able to enable your rights over your information.
8. How long do we keep your information for?
We keep User’s personal data for up to five (5) years from the data of his/her last activity, as long as we are not required by other obligations at law to keep such data.
Video on Demand is stored for up to one (1) year from the collection.
Records of transactions will be kept for up to five (5) years after they have been carried out to comply with the company’s obligations for tax and other relevant legislation.
9. Security
The security of your Personal Information is important to us. Although we cannot fully guarantee the security or confidentiality of all the information provided to us, we make all efforts to have in place physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access and maintain data security information.
All financial information shall be collected and processed via a third party. Such financial information will be encrypted using secure socket layer technology (SSL). Furthermore, our payments processing vendor shall maintain the confidentiality, security and integrity of the personal and financial information it obtains from our Website and will use this information only on our behalf.
10. Phishing
Phishing attacks are attempts to steal consumers’ personal identity data and financial account credentials. “Phishers” use ‘spoofed’ e-mails to lead consumers to counterfeit websites designed to trick recipients into divulging sensitive personal information such as credit card numbers, account usernames, passwords, and social security numbers. Please note that we do not send emails asking you to confirm sensitive personal information. If you receive such email communication, please forward it immediately to info@realplay.com to delete the fraudulent site’s administrator from your computer.

All Users have the right to:
Access to the personal information provided by you;
Request rectification of personal data that you consider incorrect;
Request for restriction of processing of data;
Request erasure of data;
File an objection about processing of your data;
Request to export your data; and
Be informed about automated individual decision-making, including profiling; and
Your rights may be exercised in accordance with the applicable laws, which might include restrictions on when you can exercise these rights.
